Law of the Republic of Kazakhstan No. 446 of 1 July 2003 regulates compulsory insurance of the civil liability of vehicle owners. It defines the parties to the insurance, the procedure for entering into a contract, the rights of victims, insured events and the rules for making payments.
What the solution provides
MTPL compensates the harm provided for to the life, health and property of third parties.
Individual calculation
The premium and the settlement are determined by the current version of the law and the data in the insurance database.
Current version: the legal act is amended regularly. For a legally significant decision, use the continuously updated text in the official legal information system Adilet.

What the law regulates
- who is required to enter into a vehicle owners' MTPL contract;
- who is regarded as the policyholder, the insured and the victim;
- the procedure for arranging an electronic contract;
- the scope of the insurer's liability;
- the definition of an insured event and of the harm caused;
- the documents for an insurance payment;
- the rights and obligations of the parties;
- dispute resolution and referral to the insurance ombudsman.
Subject of compulsory insurance
The subject is the insured person's property interest connected with the obligation to compensate for harm caused to the life, health or property of third parties in the operation of a vehicle as a source of increased danger.
MTPL is not CASCO. It protects liability to the victim, not the at-fault driver's own car. Damage to, theft or loss of your own vehicle requires voluntary CASCO insurance.
Who must have a contract
The liability of owners of registered vehicles, or vehicles subject to registration, as well as of other categories expressly named in the law, is subject to compulsory insurance. The legislation changes, so the current list should be checked in Article 5.
A vehicle may not be operated without a valid contract where insurance is compulsory. Before a journey, check the term and the accuracy of the details in the electronic database.
What types of harm are covered
| Type of harm | What is considered | Restriction |
|---|---|---|
| Life | The consequences of the victim's death | The amount is determined by law |
| Health | Injuries, disability and other established consequences | Medical documents are required |
| Property | Damage to or destruction of a car and other property | Within the sum insured |
| Not covered | Non-pecuniary damage, lost profit and certain contractual losses | See the current Article 10 |
Electronic insurance policy
The MTPL contract is arranged in electronic form, and the information is passed to the unified insurance database. The client needs to check:
- the name and licence of the insurance company;
- the full name and identification details of the policyholder;
- the vehicle details;
- the list of insured persons, if one applies;
- the start and end dates of the contract;
- the insurance premium and the confirmation of payment.
Do not give intermediaries confirmation codes, passwords or an electronic digital signature. After the policy is issued, keep the notification or insurance certificate and verify the details.
What determines the cost of MTPL
The insurance premium is calculated under the rules of the law using a base premium and the established coefficients. The calculation may be affected by the territory of registration, the type of vehicle, the age and driving experience of the driver, the age of the vehicle and the insurance history.
For 2026, adjustment coefficients have been approved by a separate regulatory act. The specific cost is determined on the date of issue from the data in the unified database and the rules in force.
What is recognized as an insured event
An insured event is the arising of the insured person's civil liability for harm caused to a victim in the operation of the specified vehicle. The circumstances must be documented and confirmed in the prescribed manner.
The mere fact that a car has been damaged is not always sufficient. The parties, the liability, the validity of the contract, the causal link and the amount of harm are all checked.
Documenting a road accident
A road accident is documented in the standard way with the police, or in a simplified way using the Europrotocol when all the established conditions are met. The Europrotocol does not apply to every collision.
- two vehicles are involved in the incident;
- there are no injured persons;
- the participants hold valid MTPL contracts;
- there is no disagreement about the circumstances;
- the damage is within the established limit;
- other requirements of the simplified procedure are met.
In the event of injuries, a dispute, a participant who has left the scene or a more complex situation, call the police and follow the standard procedure.
How to claim a payment
- Ensure safety and document the incident.
- Notify the insurance company through an official channel.
- File the claim with the documents required by law.
- Obtain confirmation stating the list of documents and the date of acceptance.
- Present the damaged property for inspection.
- Review the determination of the amount of harm.
- Receive the decision and the insurance payment.
The insurer may not arbitrarily expand the list of documents set by law. If additional material is requested, ask for the legal basis.
Time limit for the insurance payment
Under the standard procedure, the insurance payment is made within fifteen working days of the insurer receiving the full set of documents required by law.
The start of the period is confirmed by a certificate or an electronic notice of the documents received. If the set is incomplete, the insurer must say exactly what is missing.
If the property of several victims is damaged
For cases with several victims, the law provides a special procedure and time limits for the start of payment. Do not wait indefinitely for all the participants to submit their documents: check the current rule in Article 26.
Rights of the victim
- to file a claim for an insurance payment;
- to receive confirmation of the documents accepted;
- to take part in determining the amount of harm;
- to see the result of the assessment and the calculation of the payment;
- to receive a reasoned written refusal;
- to apply to the insurance ombudsman;
- to claim from the at-fault party the difference above the insurance payment, in the cases provided for.
Insurance ombudsman
The insurance ombudsman considers disputes between clients and insurance organizations. Since 1 January 2024, applying to the ombudsman has been a mandatory pre-trial stage before going to court over an insurance dispute.
Keep the contract, the claim, the certificate of documents, the calculation of harm, the refusal and the correspondence. The current procedure for submitting an application should be checked on the ombudsman's official resource and in the law in force.
Direct settlement
In the cases established, the victim may apply to their own insurer under the direct settlement mechanism. Availability depends on the participants in the event, the contracts in force and the conditions of the law. Ask your insurance company about the procedure.
If the at-fault driver has left the scene
Do not leave the scene; call the police and record the traces, the witnesses and the cameras. In the cases provided for by law, the Insurance Payments Guarantee Fund compensates harm to life and health and funeral expenses when the person responsible has fled and has not been identified. Damage to a car is not covered by the Fund on this basis.
Common mistakes
- buying a policy from an unknown intermediary without checking the insurer;
- not checking the details of the electronic contract;
- leaving the scene of a road accident without a lawful reason;
- repairing the car before it has been inspected;
- handing over documents without a receipt;
- regarding MTPL as insurance of your own car;
- missing the notification deadline and the pre-trial procedure;
- using an old version of the law.
How to use the law correctly
- Open the current version in the Adilet legal information system.
- Check the date of the amendment and when the changes enter into force.
- Read the article together with its footnotes and transitional provisions.
- Cross-check related regulatory acts and rules.
- For a complex dispute, obtain professional legal help.
Compulsory insurance is provided by a licensed company
Compulsory insurance services are provided only by insurance companies and branches of non-resident insurance organizations that hold the appropriate licence in Kazakhstan. An agent, a website or a consultant may help with arranging the policy, but the insurer is the organization named in the contract.
