Important: the document was posted on the site earlier. Regulatory acts in this area have been amended many times and may have been replaced by new ones, so before applying it, check whether the resolution is still in force and find the current rules in the "Adilet" legal information system (adilet.zan.kz).
What an occupational risk class is
An occupational risk class is an indicator that reflects the level of workplace injuries and occupational disease in a particular type of economic activity. The more dangerous the working conditions in an industry, the higher the class. Office work and work in mining or construction differ significantly in their level of risk, and the rules make it possible to take this difference into account.
The rules for assigning types of economic activity to occupational risk classes determine how a class is assigned to each type of activity, and thereby form the basis for differentiating insurance tariffs.
Link to compulsory employee accident insurance
Occupational risk classes are applied primarily in compulsory insurance of an employee against accidents in the performance of employment (official) duties — known as OSRNS. An employer is obliged to insure its employees, and the amount of the insurance tariff depends on the occupational risk class to which the employer's main type of economic activity is assigned.
Therefore, correctly identifying the type of activity and the class directly affects the cost of the OSRNS policy. A mistake in either direction causes problems: an understated class can lead to disputes with the insurer and comments during inspections, while an overstated one leads to overpayment.
Who it applies to
- employers — legal entities and sole proprietors that use hired labor;
- insurance organizations, which calculate the OSRNS tariff;
- accountants and occupational safety specialists responsible for documents on employee insurance;
- government bodies that supervise compliance with the requirements on compulsory insurance.
How the class is determined in practice
- Determine the organization's main type of economic activity — using the general classifier of types of economic activity (OKED) and the registration data.
- Find this type of activity in the rules currently in force and the occupational risk class corresponding to it.
- If the organization carries on several types of activity, clarify which of them is recognized as the main one under the rules.
- Provide the information to the insurer together with data on the number of employees and the payroll.
- If the main type of activity changes, inform the insurer — this may affect the tariff.
Typical employer mistakes
- using an outdated list or a document that is no longer in force;
- stating a type of activity that does not match the registration data;
- failing to take into account a change of main type of activity when renewing the contract;
- declining an OSRNS policy on the view that a low risk class exempts the employer from insurance — the obligation to insure employees does not depend on the class;
- understating the number of employees or the payroll in the application.
What information to prepare for an OSRNS calculation
- the employer's registration data and main type of economic activity;
- the number of employees, including by department and occupation;
- the annual payroll;
- information on workplace accidents in previous periods, if there were any;
- information on occupational safety measures.
Complete and accurate data helps the insurer to apply the risk class correctly and to avoid a recalculation of the premium after the contract has been concluded.
Frequently asked questions
Does the risk class affect the amount paid to an employee?
The class affects the tariff and the cost of the policy. The amount paid to an injured employee is determined by the OSRNS legislation, the degree of loss of working capacity and the terms of the contract.
Where can I check which class has been assigned to my type of activity?
In the current version of the rules published in "Adilet". When calculating the premium, the insurer also checks the type of activity against the class, and if there is a discrepancy it is better to find out the reason before concluding the contract.
Can I estimate the cost of the policy in advance?
Yes, a preliminary calculation is available in the OSRNS calculator. For details of programs for employers, see the employee insurance section.
