Bank borrower insurance in Kazakhstan

Insurance taken out when arranging a loan can protect the borrower's property, life, health or ability to work, and reduce the financial consequences of unforeseen events. At the same time, the policy should be assessed as a separate contract: it is important to understand which risks are covered, who will receive the payment, how much the service costs and whether it can be declined.

The borrower's main right: a bank or microfinance organisation may not impose a particular insurance company or restrict the client's choice of insurer. If insurance is linked to a loan, compare offers and ask for the complete set of documents before paying.

Which types of insurance may be offered

  • Collateral property insurance - of an apartment, house, car or other object pledged as security.
  • Life insurance - protection in the event of the death of the insured person, within the terms of the contract.
  • Accident and illness insurance - a payment in the event of injury, disability or another situation specified in the policy.
  • Disability insurance - assistance in the event of a confirmed temporary or permanent loss of the ability to work.

The specific cover depends on the rules and the contract. The name of a product does not in itself guarantee payment for any cause: what matters is the definition of the insured event, the exclusions, the waiting period, the limitations and the procedure for confirming the event.

Voluntary and compulsory insurance

Insurance products offered together with a consumer loan generally belong to voluntary insurance. Certain requirements may arise in connection with collateral and the terms of the loan agreement, but the bank must explain the basis, the parameters of the required protection and the permissible options.

Services in compulsory lines of insurance are provided only by insurance companies holding the relevant licence. A bank may act as an intermediary or insurance agent, but it does not replace the insurer and does not assume the insurer's payment obligations.

The right to choose an insurance company

Since 2012, a bank borrower has been entitled to choose the insurance company himself, and the rules in force continue to develop this principle. If the loan terms provide for insurance, the financial organisation must not restrict the client's choice. If the insurer chosen by the client does not offer a suitable product, the bank must present several alternatives with tariffs and terms so that the choice is an informed one.

The chosen policy must meet objective parameters of protection: the sum insured, the list of risks, the period of validity and the payment procedure. The bank must not worsen the terms of the loan merely because another company was chosen, if the insurance cover meets the established parameters.

What to check before signing

  1. The insurer: full name, licence, contact details and official website.
  2. The insured person and the beneficiary: who receives the payment and in what circumstances.
  3. Insured events: the exact events, not just the advertising description of the product.
  4. Exclusions: illnesses, circumstances, types of employment and other limitations.
  5. Cost: the amount of the premium, the method of payment and the effect of including the amount in the loan principal.
  6. Term: whether the insurance period matches the loan term.
  7. Claims procedure: notification deadlines, documents and channels for submitting an application.
  8. Termination terms: the possibility of withdrawing and receiving a refund of part of the premium.

Cooling-off period and early repayment

For an insurance contract linked to a loan, there is a right to withdraw from it within a period set by law after conclusion. According to the current clarification of the financial regulator, this period is 14 calendar days. Before submitting the application, check whether the absence of cover will affect the performance of separately agreed collateral requirements.

On full early repayment of the loan, the client should find out about terminating the contract and the refund of part of the insurance premium for the unused period. The bank is obliged to notify the borrower of this right in the cases provided for by law. The amount of the refund depends on the contract, the period of protection and the applicable rules.

Why the sum insured may differ from the outstanding debt

In some products the sum insured decreases together with the debt, in others it remains fixed. If the bank is named as the beneficiary, the payment may first be directed to repaying the debt, with the remainder going to another named person. These terms need to be clarified in advance, especially for life and disability insurance.

What to do when an insured event occurs

  1. Notify the insurer of the event immediately, in the manner provided for.
  2. Obtain the registration number of your application and the list of documents.
  3. Collect medical, police, bank or other supporting documents.
  4. Hand over documents with an inventory and keep copies.
  5. Request a written decision and a detailed calculation of the payment.
  6. If you disagree, use the claims procedure, an application to the insurance ombudsman and other lawful means of protection.

Typical borrower mistakes

  • signing the application without reading the insurance rules;
  • judging a product only by the monthly payment, without calculating the full cost;
  • incorrect or incomplete information about health and employment;
  • missing the deadline for notifying an insured event;
  • having no copies of documents and no proof that they were handed over;
  • believing that insurance will automatically repay the loan in any life situation.

Brief conclusion

Bank borrower insurance can be a useful financial safeguard if the cover matches real risks and the client understands its cost. A borrower is entitled to choose the insurance company, study alternatives and demand transparent terms. Before signing, compare the policy with the loan agreement, check the exclusions and the procedure for refunding the premium, and obtain all explanations and decisions in writing.
