Compulsory civil liability insurance of owners of facilities whose activity involves a risk of causing harm to third parties.
2026 update: compulsory liability insurance of owners of hazardous facilities is arranged and applied in accordance with the current version of the legislation of the Republic of Kazakhstan. Before concluding the contract, check the facility category, the sum insured, the circle of responsible persons, the required documents and the procedure for notifying of an insured event.
Compulsory civil liability insurance of owners of facilities whose activity involves a risk of causing harm to third parties
An insured event is an accident at the facility that has caused harm to the life, health and (or) property of third parties.
The insurance payment in respect of victims' property is made in the amount of the harm caused, as determined by the insurer or an independent expert on the basis of the accident investigation report, court decisions and other materials containing data on the amount of harm caused. The payment for harm caused to the life and health of victims is calculated on the basis of the limits established by the Law* and depends on the severity of the harm caused (death, degree of disability or inpatient treatment without a disability being established).
Amount of the sum insured
1. The sum insured under a compulsory liability insurance contract for facility owners is set in the amount of the monthly calculation index established by the law on the republican budget for the relevant financial year:
- 600 thousand – if the maximum possible number of victims as a result of the harmful effect of hazardous production factors exceeds four thousand people;
- 350 thousand – if the maximum possible number of victims as a result of the harmful effect of hazardous production factors is more than two thousand people but does not exceed four thousand people;
- 225 thousand – if the maximum possible number of victims as a result of the harmful effect of hazardous production factors is more than one and a half thousand people but does not exceed two thousand people;
- 115 thousand – if the maximum possible number of victims as a result of the harmful effect of hazardous production factors is more than seven hundred and fifty people but does not exceed one and a half thousand people;
- 50 thousand – if the maximum possible number of victims as a result of the harmful effect of hazardous production factors is more than three hundred people but does not exceed seven hundred and fifty people;
- 30 thousand – if the maximum possible number of victims as a result of the harmful effect of hazardous production factors is more than one hundred and fifty people but does not exceed three hundred people;
- 12 thousand – if the maximum possible number of victims as a result of the harmful effect of hazardous production factors is more than seventy-five people but does not exceed one hundred and fifty people;
- 5 thousand – if the maximum possible number of victims as a result of the harmful effect of hazardous production factors is more than ten people but does not exceed seventy-five people;
- 1 thousand – for other declared hazardous production facilities, if the maximum possible number of victims as a result of the harmful effect of hazardous production factors is up to ten people.
The insurance rate is from 0.72% to 2.02% of the sum insured.
Note: if the activity of the facility corresponds to several of the categories listed above at once, the highest of the amounts stated in the categories is used to determine the minimum sum insured.
Liability insurance of owners of hazardous facilities is carried out in accordance with the Civil Code of the Republic of Kazakhstan and on the basis of the Law of the Republic of Kazakhstan "On Compulsory Civil Liability Insurance of Owners of Facilities Whose Activity Involves a Risk of Causing Harm to Third Parties" dated 07.07.2004 No. 580-II.
Who is required to insure liability
The obligation to conclude the contract lies with the owner of a facility whose activity involves a risk of causing harm to third parties. This may be the owner of the facility or a person who operates it on another lawful basis. Whether a facility is classed as hazardous is determined by legislation on industrial and civil safety, so the status of each facility should be checked separately. The contract is concluded before operation begins and must remain in force continuously.
How the sum insured and the cost of the policy are calculated
The sum insured is expressed in MCI. To convert it into tenge, the number of MCI corresponding to the facility category is multiplied by the MCI value set by the law on the republican budget for the relevant year. The category is determined by the maximum possible number of victims – this information is usually contained in the facility's industrial safety documents.
The cost of the policy is the sum insured multiplied by the rate. The specific rate within the range from 0.72% to 2.02% depends on the characteristics of the facility and the insurer's risk assessment. You can make a preliminary estimate of the premium in the hazardous facilities insurance calculator.
What to check in the contract
- that the facility, its address and its category are stated correctly;
- that the sum insured corresponds to the category determined by the number of possible victims;
- the term and the absence of a gap between the old and the new contract;
- the procedure and deadlines for notifying the insurer of an accident;
- the list of documents required for payment;
- the grounds on which the insurer is released from payment or has the right to bring a recourse claim.
What to do in an accident
- Take measures to eliminate the consequences of the accident and reduce the harm, and ensure people's safety.
- Report the incident to the authorized bodies in the manner established by legislation on industrial and civil safety.
- Notify the insurer within the deadlines provided for by the contract and the law.
- Ensure the participation of the insurer or an independent expert in the inspection and assessment of the damage.
- Obtain the accident investigation report and collect documents confirming the amount of harm.
- Inform the victims that they may apply to the insurer for payment.
Common mistakes of facility owners
- understating the facility category and, as a consequence, an insufficient sum insured;
- missing the contract renewal deadline and operating the facility without insurance;
- late notification of the insurer about an accident;
- relying only on the compulsory limit, although the real damage may turn out to be higher.
For significant risks, it makes sense to supplement compulsory cover with voluntary liability insurance.
