Public procurement in the Republic of Kazakhstan is carried out mainly in electronic form through the official web portal. Below is an up-to-date reference section on the participation procedure, key stages and documents, as well as an archived video lecture included in the original version of the material.
Which documents regulate public procurement
The basic document is the Law of the Republic of Kazakhstan "On Public Procurement". The procedures are detailed in the Rules for Conducting Public Procurement, approved by Order of the Minister of Finance of the Republic of Kazakhstan dated 9 October 2024 No. 687. The official texts with their amendment history are available in the Adilet legal information system.
The practical work of customers, organisers and potential suppliers takes place on the public procurement web portal. The portal publishes notices, documentation, minutes, contracts, notifications and technical information. For legally significant actions, the user needs to be registered and hold a valid electronic digital signature.
Basic principles of procurement
The legislation is aimed at the efficient use of funds, openness, fair competition, equal opportunities for suppliers and the accountability of participants. The terms of a procurement must not unreasonably restrict the circle of potential suppliers. At the same time, a participant is obliged to assess carefully the qualification requirements, the technical specification, the deadlines and the draft contract.
How the procurement process works
- Planning. The customer prepares and publishes a plan and determines the subject of the procurement, the volume, the deadlines and the allocated amount.
- Preparing the notice. The organiser chooses a method provided for by law and prepares the documentation and the technical specification.
- Publication on the portal. Potential suppliers review the terms, deadlines and clarifications.
- Submitting bids. The participant attaches the required information and signs the bid with an electronic digital signature before the prescribed deadline.
- Review and results. The organiser checks compliance with the requirements and publishes the minutes.
- Concluding the contract. The winner signs the contract on time and, if necessary, provides the types of security required.
- Performance. The delivery of goods, performance of work or provision of services is confirmed by documents on the portal; the parties monitor deadlines, quality and payment.
Methods of procurement
The specific method is determined by the customer in accordance with the law and the rules. The system uses competitive procedures, including tender, auction and request for price quotations, as well as procurement through the electronic shop and, in the cases provided by law, single-source procurement. A method should not be chosen by its name alone: the conditions, grounds and restrictions should be checked against the current version of the regulations.
What a supplier should check before participating
- compliance with the qualification requirements and the absence of restrictions established by law;
- the exact name and characteristics of the goods, work or service;
- the deadlines for bid submission, delivery, performance and payment;
- whether security is needed for the bid, contract performance, an advance payment or an anti-dumping amount;
- licences, permits, certificates and information about subcontractors, if required;
- the conditions of the national regime and special requirements on the origin of products;
- the risks, penalties, acceptance procedure and grounds for terminating the contract.
Typical mistakes of potential suppliers
Bids are most often rejected not because of the price but because of non-compliance in the documentation: an incorrectly chosen item, incomplete information, discrepancies in the technical proposal or a missed deadline. It is dangerous to copy documents from another procurement without rechecking them. Even a small inaccuracy in a model, unit of measurement, deadline or the signatory's authority can affect the outcome.
Before sending, it is useful to have the bid independently checked against a checklist. After signing, make sure the portal has confirmed that it was received. All requests for clarification and appeal actions must be made within the prescribed deadlines and through the designated functionality.
What the customer should pay attention to
It is important for the customer to describe the subject of the procurement clearly and measurably, not to use requirements that unreasonably restrict competition, to respond to comments in good time and to document decisions. The technical specification should make it possible to verify the result objectively. Price is a significant but not the only factor: the quality of planning and of the draft contract directly affects performance.
Appeals and oversight
A participant has the right to protect its interests in the manner established by law and the rules. A complaint must identify the specific decision or action, the arguments and the supporting materials. In parallel, state audit, desk-based control and public monitoring apply in the procurement sphere. Deadlines and review routes depend on the stage of the procedure, so preparation of a complaint should not be postponed.
